This privacy policy relates to the Pinergy Group and the personal data that they may handle on behalf of their clients or members of the public, the secure and legal handling of that data is of paramount importance to us, and every effort will be made to ensure the safety of this information while it is in the control of Pinergy.

Who We Are
Pinergy comprises of a group of companies formed together with Pinergy Solar Electric and Acutrace. This privacy notice relates to all three companies.
- New Measured Power Limited (t/a Pinergy) is a company limited by shares and registered in the Republic of Ireland, which belongs to the group of companies formed together with Pinergy Solar and Acutrace (“Pinergy”).
- Rookery Consulting Ltd t/a Pinergy Solar of Killanne, Rathnure, Enniscorthy, Co.Wexford, Ireland, Y21 W523, Ireland (“Solar Electric”)
- Acutrace Ltd of F4 Riverview Business Park Nangor Road, Dublin D12 K7X9, Ireland (“Acutrace”)
Together these three companies form the ‘Pinergy Group’, each company within that group provides a different service. We’re helping our customers make data informed choices today, to take control of their energy tomorrow. Since 2024, we are now part of the Sojitz Corporation.
What Personal Data we handle
We receive personal data about you from three sources. From you, from third parties and from the services we provide you. More detailed and specific information regarding categories of personal data we process from you can be found at the end of this page.
Personal data provided by you:
We process personal data you provide us when creating your profile in our apps (full name, contact details, payment method), when you enquire with us about our products and services (contact information), when you agree to receive Pinergy marketing information (name, contact information) or when you ask us to provide you with a product or service (full name, postal address, mprn). We will also manage grant applications or fill out relevant paperwork when you are selling energy back to the grid.
Personal data provided by a third party authorised by you:
You may authorise third parties to share personal information with us. For example, developers of new build homes share information about buyers with us to allow us to transfer supply unless the buyer switches to another electricity supplier (full name, contact details, payment method).
Personal Data automatically recorded from your devices, products or services:
When you use our products or services, we receive information automatically recorded from your device, smart meter or the EV Charger regarding your energy data usage, transactions made with your account and information regarding those transactions.
What we do with your data
We process your personal data to provide you with an effective service and the best customer experience. For doing so, we will rely on specific legal basis according to the processing activity and its purposes.
Our main objective is to provide you with the best service in the market. To do this, we will need to evaluate our performance and analyse your interactions with our service. When we process your personal data for this purpose, as well as for other purposes such as preparing proposals, or trouble shooting problems we will rely on our legitimate interests.
We will also process your personal data to update you on improvements to our services, to promote new services or products that may be of interest to you and to share our special deals. To carry out our marketing activities, we will always need your consent or use legitimate interests. Please note that you can withdraw your consent at any time.
We also carry out some statistical activities on the data you provide us with, but we will apply specific safeguards and techniques such as deidentification of data so specific individual cannot be identified.
We process your personal data when it is necessary for the performance of your contract where you as a data subject are party. To fulfil our service contract as well as to provide you with customer support and technical assistance, we will process only the necessary personal data. We may also contact you with service messages which will contain important information about your service such as interruptions or unused benefits of your programme.
Where our customer is a Landlord we will give them access to consumption information in aggregate in relation to the property that they are in charge of, where there may be a changeover of tenants, more granular data may be shared for the facilitation of this process.
Sometimes we are required by law to process your personal data. Under certain circumstances, we may require to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).
We may have a requirement to share information with relevant authorities, such as An Garda Síochána, in the course of an investigation and we will also share certain information with relevant authorities if we were of the opinion that there may be a threat to life to any person, or on the basis of a valid legal request in the course of an investigation by government authorities. Where you are switching from Pinergy to another energy provider while a debt is owed, you may be subject to a debt flag which will inform the proposed future provider of the fact that a debt is owed to Pinergy.
We are under an obligation to notify the ESB about certain information, when you are onboarded as a customer, to show you are a Pinergy customer and also where there is a vulnerable person present at a property, nature of vulnerability, address, name and contact details, MPRN, and nature of ailment. Automated Decision Making and Profiling
No decisions are taken based solely on automated decision making which would have a legal or equally significant impact on a user as the data is used for creating insights on energy consumption.
The exception to this is in the context of pre-pay electricity services where service will be discontinued once the available credit reaches zero or another agreed credit threshold, or post-paid services where an account has outstanding bills. This processing is necessary for the performance of the contract between us as the Data Controller and the data subject as a user of our services.
The operation of the Pinergy application and smart services require profiling personal data to identify your usage patterns in a building and ensure usage information is made available to you. Profiling and analytics are carried on consumption data, where this is detailed analysis it will be carried out with your consent, statistical data will be captured as part of our legitimate interests.
How long we keep your data
We keep your data as long as necessary for the legitimate purpose of the processing. In practice, this means that we have a specific retention period for each category of data depending on the purposes that they serve.

Who we share your data with
We don’t work alone. In Pinergy, we work together with other companies to provide you with the best experience.
Within the Pinergy Group
We work closely within the Pinergy group and to that end we have a Joint Controller Agreements in place that allows us to share a range of back office and administration support as well as engage in cross-sales and bundled sales activities for each other’s products, where this is beneficial to customers. The ‘Pinergy Group’ is majority owned by Soljitz corporation who will be supplied with certain data of Pinergy customers from time to time in very limited circumstances that will be under strict controls to ensure the rights of all data subjects.
Other data sharing
We will also work with other companies that support us in carrying out our business activities and will only do this on the basis of our instructions.
- Installation Contractors: Pinergy uses 3rd party contractors to install and maintain budget controllers, meters, or other equipment.
- IT Service Providers: Pinergy uses a range of IT service providers to host our systems, develop and maintain software, and support our internal information management processes.
- Infrastructure Providers: Infrastructure providers such as the ESB Smart Meter Network or Electric Vehicle charger providers can also process data on behalf of Pinergy to enable us to deliver our products and services.
- Billing, Accounting, and Finance Service Providers: We avail of the services of a number of third parties to support our billing processes, our accounting and payments management processes, and our finance and credit control processes.
Some of our processors are based outside of the European Economic Area and transfers to third countries may be necessary. In such cases, Pinergy will only undertake such transfers if legal safeguards are in place to ensure that your personal data and your rights are protected.
Your Data Protection Rights
Where Pinergy is acting as a Data Controller, you have rights under EU Data Protection law. These rights are:
- A right of access which allows you to request a copy of all your data in an intelligible form (Article 15 GDPR)
- A right of rectification which allows you to request a correction of errors or inaccuracies in the data that we hold relating to you (Article 16 GDPR)
- A right to object to processing and to “opt-out” of having your data processed by us on the basis of our legitimate interests or a public interest basis unless we can demonstrate compelling legitimate grounds that over-ride your interests, rights, and freedoms. (Article 21 GDPR)
- A right to erasure in certain specified circumstances. This right does not apply where we are processing data for compliance with a legal obligation, for reasons of public interest in relation to public health, for archiving purposes for historical or scientific research, or where necessary to establish or defend legal claims (Article 17)
- A right to restrict processing in certain circumstances (Article 18)
- A right to data portability that entitles you to receive from the data controller your personal data in a structured way and a commonly used format and transmit them to another data controller.
- Under GDPR individuals also have rights to seek compensation for infringement of their data protection rights under the legislation.
